TERMS & CONDITIONS
A. Entry Eligibility. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. To be eligible to enter into The Color Imaging Contest 2008 (this ìContestî), you must be 18 years of age or older and a resident of India. Employees of Sponsor or Co-Sponsor, and their respective immediate families are not eligible to enter or win.
B. How to Enter. To enter, contestants must submit a completed Entry Form. The completed Entry Form must be attached to the work of the Entry, and are to be placed into an envelope or other appropriate container. Please use adequate measures to protect the Entry against damage during transport or delivery. An Entry together with an Entry Form may be submitted by an individual or by a group (however, only one award will be awarded for one winning Entry). Photocopies of the entry form is permitted. There is no restriction on the number of Entries you may submit to this Contest. However, use of the same Entry for other Sponsor and/or Co-Sponsor contests and/or awards is not permitted.
C. Entry Requirements. An 'Entry' is a digital image printed by an inkjet or laser printer. Entries printed in photo labs will be rejected. Unless specified otherwise in writing by Sponsor and/or Co-Sponsor, an Entry may be of any style, subject, or topic you wish. All entries must include two hard copies of the work and a high resolution (300dpi) soft copy in a properly labeled CD. An Entry must be an original and unpublished work. There is no restriction on the size of the Entry, or the printer used to print out the Entry. There is no need to frame the Entry. However, please indicate the top and bottom of the Entry on the back of the Entry. All Entries become the physical property of Sponsor and/or Co-Sponsor, and will not be returned.
D. Entry Submission Deadline. To be eligible, all entries must reach us on or before 31st August, 2008.
E. Notification of Winning Entries. The names of the contestants submitting winning eligible Entries (respectively, 'Winning Contestant(s)' and 'Winning Entry(ies)') will be posted on the website in the middle of November 2008 and individual recipients will be notified by post.
F. Award Ceremony and Exhibition of Winning Entries. An exhibition showcasing the top Winning Entries is planned to be held in conjunction with an award ceremony for the corresponding Winning Contestants. Winning Entries will be displayed at exhibitions and other events, in publications, on web sites operated by or for Sponsor and/or Co-Sponsor, and/or in materials in connection with this Contest, and may also be used in product catalogues and other materials produced by or on behalf of Sponsor and/or Co-Sponsor,including but not limited to, promotional materials for any subsequent contests sponsored by Sponsor and/or Co-Sponsor.
G. Release. By entering this Contest and/or accepting an award, contestants release and agree to hold harmless Sponsor and Co-Sponsor, and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind, including death, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of an award or participation in this Contest.
H. Representations. By entering this Contest, you represent that your Entry is original and of your own creation, publication of the material will not violate the rights of any kind of any third party, and you have provided all necessary permissions and releases in connection therewith. You also represent that your Entry is not obscene or offensive and that it does not violate community decency standards. Entries that are obscene, offensive or in violation of community decency standards, as determined by the judges, in their sole discretion, will not be eligible to enter or win.
I. Use of Personal Information. Personal information provided in the Entry Forms shall be appropriately managed by Sponsor and/or Co-Sponsor, and shall not be provided to any third party, except that, by entering this Contest, you agree to allow Sponsor to use your personal information contained on the Entry Form: (i) in connection with the publication of your Entry and for promotional purposes (except where prohibited), without review, notification, or approval; and (ii) to provide you with information of this Contest and future colour imaging contests. Winning Contestants may be required to sign and return an affidavit of eligibility, grant of rights, tax forms, and a publicity and liability release, all within fourteen (14) days of notification, or the award may be forfeited and an alternate winner selected (alternate will be the Entry that received the next lower ranking).
J. Compliance With Official Rules. By entering this Contest, you agree to abide by these Official Rules and to accept the judgesí decisions as final. Submission of an Entry and/or acceptance of an award grants Sponsor and Co-Sponsor the non-exclusive, perpetual right to use, reproduce, prepare derivative works of (including, to edit, adapt, modify and excerpt), distribute, publish and/or publicly display the Entry for any purpose in any media currently in existence or hereafter developed without further compensation to you, which includes, but is not limited to, the right to publish your Entry on the Website.
K. Awards. Substitution or transfer of an award is not allowed, except Sponsor and/or Co-Sponsor may substitute an award for one of equal or greater value. Income tax and any other taxes on the value of an award are the sole responsibility of the Winning Contestant. Sponsor and/or Co-Sponsor will furnish to the appropriate tax authorities any required tax reporting forms relating any award awarded to a Winning Contestant. Where the term Trip to Japan is used, it means to attend the awards ceremony in Japan on December 17 – 19, 2008 (no alternative traveling dates are acceptable). The trip to Japan will consist of round trip airfare from the winner’s location to Tokyo, Japan, 2-way transfers from airport to hotel, two nights accommodation on a room-only basis, in a hotel selected by the Sponsor and/or Co-sponsor, ground transportation to the awards ceremony. All costs not stated above are to be the responsibility of the winner. In the event of that the winner in unable to travel on the set dates, or is unable to obtain the necessary Embassy/country visas, within two weeks of the departure date, they will forfeit the right to the prize. Sponsor and/or Co-sponsor may in its absolute discretion offer in substitution any alternative prize of equal value.
L. Miscellaneous. Sponsor and/or Co-Sponsor, in its/their sole discretion, reserve(s) the right to disqualify any individual it reasonably suspects or believes to be tampering with the entry process or the award mechanism, by any means, or to be acting in violation of these Official Rules. Any individual attempting to defraud or tamper with this Contest in any way will be ineligible for awards. Sponsor and/or Co-Sponsor further reserve(s) the right to cancel, terminate or suspend this Contest or any part of this Contest should any cause beyond its control, corrupt or impair the security, administration, fairness and/or operation of this Contest as determined by Sponsor and/or Co-Sponsor in its/their sole discretion. Sponsor and Co-Sponsor are not responsible for injury or damage to any contestantís (or any other personís) computer, computer peripheral or other electronic device, related to or resulting from participating or receiving materials in connection with this Contest, or any other liability or damage of any kind related to this Contest. Sponsor and Co-Sponsor are not responsible for lost, late, incomplete or misdirected Entries. All applicable laws apply to this Contest. Notwithstanding anything to the contrary herein, these Official Rules shall be construed in accordance with the laws of Japan without reference to its conflicts of laws provisions, and any dispute arising out of or in connection with these Official Rules and/or this Contest shall be, and you irrevocably agree to be, subject to the jurisdiction of the Tokyo District Court.
